Modern statutory zoning laws allow the community in general, through the political process, to participate in how real property may be acquired, its limitation of use and if, and to whom, it may be sold. Such was unheard of in the original common law. Any limitation on use of the land was strictly within the province of the land owner. Are modern land use laws necessary or should we simply let the free market establish land use?
