1. Is there any compelling reason to make a legal distinction between real and personal property? Should all property rights be treated the same, whether concerning real or personal property? 2. Such was unheard of in the original common law. Any limitation on use of the land was strictly within the province of the land owner. Are modern land use laws necessary or should we simply let the free market establish land use?
