Assignment:

Scenario

You are an employee of the Competition and Consumer Protection Commission.  You have been invited to write an article for the ‘Irish Times’ Newspaper answering questions on consumer issues. 

You have been asked to explain the role of the Competition and Consumer Protection Commission and to answer questions sent in to the newspaper by members of the public.

Finally, you are asked to explain how EU law impacts on Irish consumer protection legislation.

PLEASE NOTE: YOU MUST COME UP WITH CONSUMER SCENARIOS THAT WILL ALLOW YOU TO ANSWER QUESTIONS IN RELATION TO THE FOLLOWING:

1.      Can the Competition and Consumer Protection Commission take an action on behalf of someone who has an issue with a retailer? (Please explain your answer)

2.      Can a business take an action under the Sale of Goods and Supply of Services legislation? (Please explain your answer)

3.      Does a consumer have any rights if an item purchased is not fit for purpose?  (Please come up with a consumer scenario that will require you to answer this question)

4.      Can a consumer get her money back for something she purchased because she didn’t like it when she brought it home? (Please come up with a consumer scenario that will require you to answer this question)

5.      Would you advise someone to go down the Small Claims Court route and what issues should the individual be aware of if they choose to do so?  (Please come up with a consumer scenario that will require you to answer this question)

6.      Are there any further steps that can be taken by an individual who has won their case in the Small Claims Court but has been totally ignored by the respondent? (Please come up with a consumer scenario that will require you to answer this question)

7.      Does someone who bought a car from someone else who was not the legal owner of the car have any recourse in law?  (Please come up with a consumer scenario that will require you to answer this question)

8.      Can you explain when a clause in a contract is legally binding?  (Please come up with a consumer scenario that will require you to answer this question)

9.      Can a car under hire purchase be recovered by the car dealership?  (Please come up with a consumer scenario that will require you to answer this question)

10.  What is the difference between an operating lease and a finance lease?  (Please provide examples)
